eBay Problem, What would you do?

I bought a NOS AFM wire ramp from a dealer in the States and paid instantly via Paypal on the 9th July.

I noticed it was still showing as 'not shipped' so on the 27th July I emailed him asking if it had shipped. He replied on the 31st July with:

"Trying to find the proper box to mail it in so it does not get damaged. It will go out this sat. Sorry for the delay"

It's still showing as not shipped so on the 7th August I emailed him asking if it did indeed get posted. So far I've had no reply.

My problem is if I leave it any longer I lose the option to open a case via Paypal. I think you have 40 days to report an issue but I really need the ramp and don't want to **** him off. Any ideas?
 
Just mail him telling him you're opening a dispute purely to protect yourself because of the time frame involved and still trust him to get the item shipped out.
 
I agree with Phil. Be polite and straight forward, you have a genuine concern and have no other means to deal with it. It will either encourage him to up his game or have to deal with Paypal.
 
I usually open disputes the very second its possible to do so. No harm in doing so. Like others have said, be polite and all should go well.
 
Thanks guys, I emailed him again tonight, mentioned that i may open a dispute and he just replied:

"Sorry steve,, it will ship today. I will have a tracking number later this evening. the shape of the ramps is hard to pack, I did get the right box. don;t worry, I promice you'll get your ramp".

How freeking hard is it to put a metal ramp in the post? What a messer! I continue to be amazed at the amount of idiots like this still in business...

I would just open a dispute/claim as it sounds like he is jerking you off and just keeps trying to buy himself time until it is too late for you to claim.

I agree, he could probably have done it in the time taken to send replies to you.....
 
If he can't supply paypal with suitable evidence that he has indeed posted, they will go in your favour and you should get your money back, thats happened to me in the past and the item even turned up eventually!
Always send your messages through ebay too, just so they can see your conversations and how he's promised the world and delivered nothing.
He certainly sounds like a messer.
 
Paypal and Ebay, Despite being the same company etc, refuse to accept messages from the other as "evidence" - been there done that (Unless they have mellowed in the last 2 years). Had a guy Rip me for £100+ on a sat nav that supposedly "didn't work on arrival", which would have been quite difficult to prove since he said in a previous couple of messages that "Works great".... :(

That really sucks as i'm sure that they share information about you or me or anybody else between themselves. tbh their policies suck and fees are going up once again!! :mad:
 
I had to do this for some decals once.When I opened the dispute he went absolutely mental.I had done countless emails with no reply.
Like you I only had that small window to file a claim.He only seemed to calm down after I suggested he ask a mate how they would act if they were me

In the end I did get them - and happily cancelled the claim.

I hope you filed the claim
